This week, all eyes are on Luxembourg, where the Court of Appeal yesterday heard the appeal against the anti-suit injunction issued by the Mannheim local division in InterDigital vs Amazon. The panel led by Ulrike Voss is tasked with charting a course for the UPC in its interactions with patent courts across Europe. At the centre of the dispute is Amazon's request for an interim licence at the UK High Court and the UPC's preliminary measures against it. The dispute has developed into a jurisdictional conflict between the UK High Court and the UPC concerning the effect of the UPC's anti-suit injunction on UK FRAND proceedings.

The pace of SEP litigation across different European courts is accelerating. Cases such as Huawei vs TP-Link, Samsung vs ZTE, and Nokia vs Geely demonstrate that parties can deploy various litigation strategies, but ultimately these disputes are not being resolved cost-efficiently.
