The dispute between ZTE and Samsung over their global cross-licensing agreement for standard-essential patents presents a good opportunity for European courts to raise their profile. Most recently, the UPC positioned itself as the voice of reason with a proposal for settlement. Simultaneoulsy, the court also promoted the Patent Mediation and Arbitration Centre, which began its work at the same time.

The Paris Court of Justice is also reinforcing its reputation as a hub for pharmaceutical disputes in the complex case involving the cancer drug Velcade with a balanced partial judgment. The dispute will keep the courts busy for some time to come.

Outside the courts, the trend of private equity investors pushing into the European IP market continues: Belgian flooring innovator i4F has launched House of IP, a private equity-backed vehicle looking to acquire patent attorney firms across Benelux and Germany.

“The UPC wants to bring ZTE and Samsung to the negotiating table”

Three courts, three proposals to ZTE and Samsung for their cross-licencing agreement. So the figures are on the table. And so is an injunction as a means of exerting pressure to reach an agreement. In the global SEP dispute between the mobile phone companies ZTE and Samsung, the UPC's Mannheim local division presided over Peter Tochermann clearly did not want to add another judgment. Instead, the UPC is positioning itself as the "voice of reason" and submitting a settlement proposal.
